ZIMBABWE FROM A POSITION OF FAIRNESS

PERSONAL APPEAL


I make personal appeal to Her Majesty the Queen of the United Kingdom of Great Britain and Northern Ireland in her capacity as Head of the Commonwealth and as a contracting party to the Fourth ACP-EEC Convention, The House of Lords, The Commons and its Honorable Members and those bodies and institutions of moral values. To intervene, lobby and influence the Blair Government to act with honour, integrity and compassion by the immediate establishment of a revolving compensation fund, compensation being a prerequisite of British and International Law, for all owners of that land in Zimbabwe sold or allocated by Britain whilst a British Colony and British Territory.

Thus providing, the ingredients for stability, peace and justice in the former colony and bringing to a close a 35 year old issue which has cost the lives and injury of too many.

That this fund be under the control/ administration of the Lands Tribunal in the United Kingdom in accord with its normal compensation considerations (legal, valuation and relocation expenses where applicable) to where claims may be made. That claims be fast tracked taking into due account the personal hardship of those divested of assets.

That the above being in accord with the Constitution of Zimbabwe, I make further personal appeal to the President of Zimbabwe, Robert Gabriel Mugabe, to lend his and the support of his Government, where necessary, to those farmers, landowners and individuals pursuing compensation in the above fashion, it being clearly, in the best interests of the Nation and its populace.

PREAMBLE

Due to the significant lack of informed questions on Zimbabwe directed at the British Government it is apparent that the international public and news media in general has no idea of, or has lost track of, the issues that have incited and caused the present strife in Zimbabwe.

It is of paramount importance to correct this situation as the lives of many innocent may lie in the balance while Britain and the first world continue to push Zimbabwe into a state of civil war.

The webmaster, a British National resident in Zimbabwe, has seen the need to offer reason and make public those acts and negligence that have contributed to the current situation (loss of property, life and injury) whilst supporting fair compensation to all, a prerequisite of all law.

It is not the intent to promote a "witch hunt" resultant from some sensitive information published on this site, but rather to promote thought, reason, improvement and progress leading to better safeguards to the greater benefit of all.

That such compensation, in addition to being a fair valuation of assets and property (not at distressed values) should include three years turnover (on the basis of a forced sale), relocation allowance and pain and suffering etc. in accord with what one would anticipate within the United Kingdom.

Speaking as a victim of both the law and violence, having had part facial reconstruction and both eyes injured resultant of an attempted execution at gunpoint, there is a need to include all those victims irrespective of race, colour or creed in compensation. There are those who suffered injury or the loss of a loved one, both recent and during the UDI period resultant of the negligent lack of mandatory British protection and policing. Those of all races that had a right to expect more from their government, the then British Government, in the fifteen years of UDI than the mere presence, at the time, of a "Governor" and I ask those farmers and landowners to consider them in their deliberations and any litigation.

It is, the webmasters fervent hope, that the information disclosed on this site, will additionally, promote harmony, unity, stability and peace within Zimbabwe thus creating the environment for economic growth and foreign investment.

INTRODUCTION

It is difficult, extremely difficult, to give an account of Zimbabwe that gives credit to all those that have suffered in pursuit of the most basic of civil rights over the last hundred years and there would really be insufficient space on this site to do so.

What the webmaster has tried to depict is how the lack of Compensation at Independence coupled with the unmonitored leadership of the Administration of Law have combined with the economic blunders of those economists and institutions of finance such as the World Bank to bring about economic decay in Zimbabwe.

As opposed to Kenya where land was leased, in Zimbabwe, formally Rhodesia, land was sold on a freehold basis. British Nationals and others purchased land very often from savings in Britain in British Pounds, the funds being repatriated back to the British Government. This act was the embryo and catalyst of the Land Issue where the indigenous inhabitants of Zimbabwe wanted independence and the return of their land and those landowners wanted guarantees of security of tenure or compensation.

The then British government proposed to give Zimbabwe independence without addressing the Land Issue by simply handing all land back including that previously sold. Sadly, instead of white and black joining hands and pressurising the then British Government to effect compensation, thus allowing landowners to renegotiate with the new government providing the necessary funds for resettlement, the Smith Government declared UDI.

Incredibly, thirty five years later the executive of the Commercial Farmers Union and some of its members repeated the same mistake, be as it may, they presumably acted on flawed legal advice and panicked. Rather than address the land issue with the Zimbabwe Government and Britain they chose to publicly fund and support an opposition party and gave the impression of a UDI all over again, depicted often on the national television channel, ZTV, today.

This of course would not make the Land Issue go away as either way the land issue would remain on the agenda and, in fact, not long after the opposition party was funded and formed, they also advocated land reform, a popular vote attracting policy.

The political unrest resultant of the above has taken its toll, affecting all sectors of the economy. In fact there has been great division between the Commercial/ Industrial Sectors and the farming community within the last few years, the former blaming the latters reaction for the instability within country.

It is unlikely that the farmers and landowners will achieve full compensation from Britain without the support of the Zimbabwe Government. This government, by the insertion of "Section 16A Agricultural land acquired for resettlement" supports a claim of full and just compensation from Britain. Another government may amend the clause weakening grounds for compensation in return for aid.

Worse, given the high rate of inflation, rumours of the Presidents retirement and subsequent in-party fragmentation by those with Presidential ambition, coupled with, political unrest, international political interference and funding to the opposition we have the recipe for civil war when, there will be little chance of compensation to anyone, compensation being old news.

Again, so long as political unrest continues it will be difficult to stabilise the economy and, as is always the case, there are those international companies and countries who have already taken advantage of the cheap pickings of Zimbabwes resources as occurred in Zambia.

There are without doubt many more reasons for working together in Zimbabwe than remaining at loggerheads, to the benefit of all, thus promoting stability, justice and peace , the theme of this web site.
